Summary of Beach Bylaw 2009 by area
This page contains a summary of our current Beach Bylaw by area (ward).
General rules
Behaviour and litter
- In any dressing shed or toilet:
- no using other than for its intended purpose;
- no loitering in or around;
- no cleaning of fish; and
- no bringing, depositing, or leaving filth or rubbish.
- All surfcasters must take reasonable steps to ensure their lines or equipment do not present a safety hazard to other beach users.
- No person shall remain upon any part of the beach in deliberate view of others in such a state of undress as to cause offence.
- No person shall dump green waste on any part of the beach. Any person found discarding or dumping, or directing the discarding or dumping, of litter or green waste contrary to this Bylaw is liable to prosecution and a fine to recover the associated removal costs.
Motorised Watercraft
- All motorised watercraft shall launch and land in authorised boat launching areas only.
Horses and Stock
- Between 11am-5pm from 1 December to the end of Daylight Savings, there are restrictions on where a person may ride, drive or lead a horse.
- At all others times, a person may ride, drive or lead a horse on the foreshore EXCEPT in the Waikanae Estuary Scientific Reserve.
- Riding must be in a manner that does not cause danger or unreasonable inconvenience to any person or causes damage to the beach environment.
- Horses are only allowed on the foreshore and the appropriate marked beach accessways.
- DOC does not allow any horses in the Waikanae Estuary Scientific Reserve, including the beach foreshore.
- A permit is required to lead stock on the beach or carry out horse racing.
Beach Preservation and Harvesting
- No sand, driftwood, native estuary vegetation and stones (where they form the predominant beach material) may be removed using any power equipment or tools and/or in quantities exceeding that which can be carried on foot, unless permission has been granted by Council.
- No person may cultivate or tend to any plants on the beach, other than those naturally occurring in the District unless with prior permission from Council.
- Other than horses and dogs, no person is permitted to introduce or release any animal without prior written permission from Council.
- Council may work with landowners to ensure private accessways to the beach are consolidated to prevent harm to the coastal dune system.
Lifesaving
- No person shall interfere with any lifesaving operations.
- Council may declare an area unsafe, and erect danger notices. No person shall swim in any place declared unsafe, and no person may swim or bathe in any area after being warned by an enforcement officer or a qualified life-saving attendant.
Coastal Protection Works, Defined Areas
- No person shall interfere with any coastal protection works legally placed and maintained for the control of sand or shingle or for the prevention of erosion without written permission from Council.
- The Council may, following public consultation, declare a defined area of a beach where specific activities may (not) occur in order to limit damage to the natural environment and to provide for safety.
Aircraft and hovercraft
- No person shall land or attempt to land on any part of the beach an aircraft (as defined in the Bylaw) unless Council has given permission and all other statutory requirements are met, or it is an emergency.
- No person shall land or attempt to land on any part of the beach a hang glider or para-glider (as defined in the Bylaw) unless they are south of Ames Street in Paekākāriki.
- No person shall drive a land yacht anywhere on the beach unless they are between the Waimeha Stream Mouth and the Official Beach Access Point at Olliver Grove in Waikanae.
- No person shall attempt to become airborne from any part of the beach.
Hiring of Craft, Trading on the Beach, and Special Events
- The Council may authorise the use of any part of the foreshore for the hiring, storing, launching, and recovery of water borne craft available for public hire, and may issue a permit to persons wishing to carry out such activities.
- No person shall sell, offer for sale, or trade any article on the beach without prior written permission from Council.
- Any person wishing to hold a special event on the beach requires a permit from Council.
Paekākāriki – vehicles, motorised watercraft, horses, and hang gliding
- The entire Paekākāriki Beach is a prohibited driving area. Therefore, no person may drive any vehicle (including a two-wheeled road or off-road motorbike) on the beach, dunes, or coastal protection works unless it is an emergency or law enforcement situation or groups recognised by Council, GWRC, or DOC are carrying out restoration or beach maintenance work.
- All motorised watercraft shall launch and land in authorised boat launching areas onlyBetween 11am-5pm from 1 December to the end of Daylight Savings, no person shall ride, drive or lead a horse on the foreshore from the Southern boundary of the District to the Wainui Stream mouth.
- Hang gliders and para-gliders (as defined in the Bylaw) can land in the area between the southern side of Ames Street and Fishermans’ Table Restaurant. When doing so in that area, all possible steps must be taken to avoid causing nuisance or danger to other beach users.
Paraparaumu Raumati Ward – vehicles, motorised watercraft, horses
- The entire beach in the Paraparaumu Raumati Ward is a prohibited driving area. Therefore, no person may drive any vehicle (including a two-wheeled road or off-road motorbike) on the beach, dunes, or coastal protection works unless it is an emergency or law enforcement situation or groups recognised by Council, GWRC, or DOC are carrying out restoration or beach maintenance work.
- All motorised watercraft shall launch and land in authorised boat launching areas only.
- Cars can be parked in the authorised boat launching areas if they are displaying a disability permit.
- Between 11am-5pm from 1 December to the end of Daylight Savings, no person shall ride, drive or lead a horse on the foreshore between Jeep Road, Raumati South and the Kapiti Boating Club.
- DOC does not allow any horses in the Waikanae Estuary Scientific Reserve, including the beach foreshore on the southern end of the WESR.
Waikanae – vehicles, motorised watercraft, horses, and land yachts
- The entire beach south of Olliver Grove in Waikanae is a prohibited driving area. Therefore, no person may drive any vehicle (including a two-wheeled road or off-road motorbike) on the beach, dunes, or coastal protection works unless it is an emergency or law enforcement situation or groups recognised by Council, GWRC, or DOC are carrying out restoration or beach maintenance work.
- Vehicles (other than two-wheeled road or off-road motorbike) are allowed north of Olliver Grove to the southern end of Rodney Ave in Te Horo, but they must:
- Drive at a speed no greater than 10km/hr at official access points;
- Drive at a speed greater than 20km/hr in other areas;
- Not drive in a manner that causes nuisance or annoyance to others, causes damage to the beach, or has adverse effects on plants and wildlife.
- All motorised watercraft shall launch and land in authorised boat launching areas only.
- Cars can be parked in the authorised boat launching areas if they are displaying a disability permit.
- Between 11am-5pm from 1 December to the end of Daylight Savings, no person shall ride, drive or lead a horse on the foreshore between the Waikanae Boating Club and the Waimeha Stream mouth.
- Land yachts are allowed between the north bank of the Waimeha Stream mouth and the Official Beach Access Point at Olliver Grove.
Te Horo and Ōtaki – vehicles, motorised watercraft, and horses
- All areas except those listed below are prohibited driving areas, which means no person may drive any vehicle (including a two-wheeled road or off-road motorbike) on the beach, dunes, or coastal protection works unless it is an emergency or law enforcement situation or groups recognised by Council, GWRC, or DOC are carrying out restoration or beach maintenance work.
- Vehicles (other than two-wheeled road or off-road motorbike) are allowed:
- On the foreshore between Olliver Grove, North Waikanae to the sSouthern end of Rodney Avenue, Te Horo
- The formed shingle track through the reserve adjacent to the foreshore between the northern bank of the Mangaone Stream to the Southern bank of the Ōtaki River mouth
- The formed shingle track adjacent to the foreshore between the Northern bank of the Otaki River mouth and the official access point opposite 100 Marine Parade, Ōtaki Beach
- The foreshore between the official access point opposite 8 Marine Parade, Ōtaki Beach to the Northern limit of the District.
- Vehicles in the permitted driving areas must:
- Drive at a speed no greater than 10km/hr at official access points;
- Drive at a speed greater than 20km/hr in other areas;
- Not drive in a manner that causes nuisance or annoyance to others, causes damage to the beach, or has adverse effects on plants and wildlife.
- All motorised watercraft shall launch and land in authorised boat launching areas only.
- Cars can be parked in the authorised boat launching areas if they are displaying a disability permit.
- Between 11am-5pm from 1 December to the end of Daylight Savings, no person shall ride, drive or lead a horse on the foreshore between 100 Marine Parade to 8 Marine Parade, Ōtaki Beach and in the Waitohu Reserve.
